1. Scope of Application

The sale of products by the Seller on this site is governed by these General Conditions of Sale.

These General Conditions of Sale are considered to be fully accepted without reservations by the Buyer.

The customer's order on this Website presupposes the acceptance of all the General Conditions of Sale.

The Seller reserves the right to update the content of these General Conditions of Sale without prior notice.

3. Validity of Offers

The offers published on this site are intended only for consumers whose delivery address is located in Europe.

The offers presented on the site will be valid until the end of stock.

In the event of unavailability of an order already paid for by the customer, yellowshop.es commits to process the requested order or to refund the amount within a maximum period of 15 days, informing the customer at all times by email or telephone.

4. Description of the Offer

yellowshop.es commits to detail and describe the offered products as accurately as possible, taking into account that as they are mostly handmade products and made of leather, they may have small differences in their finish. For such cases, yellowshop.es declines any responsibility.

5. Choice and Price of the Product

The Buyer, under their own criterion, is the sole responsible for the choice of the product (shoes or accessories) subject to the sale, as well as for the use or function to which it is intended.

yellowshop.es may describe, in a purely indicative way in the general information it gives for each product, the use it considers most appropriate for that particular item, without this being able to generate any liability.

If any of our products have a computer error in the price, (wrong price or price equal to 0 euros), the product will not be served with the consequent full refund of the entire purchase amount.

Likewise, Yellowshop reserves the right to return a specific model requested and its amount in case the stock runs out or it is not in good condition.

All prices are shown in euros with all taxes included. The Value Added Tax (VAT) is included in the price. The modification of the VAT rate will be reflected in the prices not affecting the orders previously made and that are still in process.

Yellowshop reserves the right to modify the price rates without prior notice and without having to justify the change in its pricing policy.

All this without retroactive effect to orders already made pending delivery.

6. Order and Secure Payment

     6.1: Selecting the Product and Making the Payment

The customer's validation of the order presupposes the acceptance of all the present General Conditions of Sale.

When placing the first order, the customer must register in our database by filling out a form with their personal details (name and surname, shipping address) so that we can process their order. We never record the customer's bank card data.

The process that the customer must follow to make a purchase on yellowshop.es is as follows:

  • You will need to choose the product you wish to purchase from our extensive range of items.
  • Enter the product sheet you desire by clicking on the corresponding picture. Inside the sheet, choose the color and size and add to the shopping cart.
  • The Shopping Cart screen will automatically open where we can modify the quantity of the desired units or remove products in it, always clicking afterwards on update. Once here, we can continue shopping using the top filter or proceed with the purchase.
  • Click on "Place order" to proceed with the purchase process. It is at this moment when we must identify ourselves if we are already customers or sign up by filling out the form with our data if it is our first purchase.
  • The shopping cart will open again where the last products we have added to the cart and that we have not yet processed the purchase will also appear. If you are no longer interested in them, you can remove them by clicking on the remove box and must update the cart. Continue with Place Order.
  • The delivery address option will appear. You can select to send to your home (it will be the shipping address that we have previously entered in our customer file) or Pick up at Yellow Shop store. The address can be modified at this time by selecting "Change address". Once the address is confirmed, select "Place order" to go to the secure payment page.
  • We will automatically enter a secure payment environment, guaranteed by the banking entity, in which the data is encrypted and the SSL online security protocol is used. Enter the card number, expiration date, and CSV code and confirm to complete the purchase process.

yellowshop.es does not record or view the banking details of our customers as the data is entered directly on the website of the banking entity which confirms to us that the payment has been made so that we can conclude the purchase process.

     6.2: Payment Default

yellowshop.es reserves the right to refuse to process orders or make deliveries to customers who have not partially or fully paid for a previous order or with whom there is a payment dispute.

     6.3: Payment Verification

With the sole purpose of protecting our customers from fraudulent actions with their bank cards, yellowshop.es verifies all orders validated on its site.

These security checks may result in blocking those orders that may be classified as suspicious by our security services. Such orders will be unlocked when we verify, through the request for information, that the card details correspond with those of our customer. This process can delay the delivery of the product by approximately 3 or 4 days.

These requests for information will be made by email and can be carried out:

     - In case of new customers or payments with foreign cards.

     - In repeated orders or orders exceeding a certain amount.

7. Payment Security

To ensure the security of payment, yellowshop.es redirects the purchase process to the secure payment site of the banking entity itself. yellowshop.es never has access to the banking details of our customers. This service incorporates the SSL security protocol. Personal and confidential data (bank card number, expiration date, CSV code) are transmitted directly in an encrypted form to the bank's server, without being recorded on the yellowshop.es server.

The payment request is sent in real-time to the secure telepayment manager, who issues an electronic certificate as proof of the amount and date of the transaction made.

8. Identification

The customer will need to fill out the form with their personal details only on the first purchase at yellowshop.es. On subsequent purchases, they will only need to indicate the email and password with which they registered. In the event of loss or forgetting the password, they can request a new one via the Web or by email. A new password will be sent to their user email.

The password is strictly confidential and personal, it should not be disclosed to anyone.

To facilitate the identification of the customer, they expressly authorize yellowshop.es to record files called "cookies" on their hard drive with their password and username for the sole purpose of facilitating navigation, simplifying the purchase process or browsing.

9. Delivery

 

In Mainland Spain and Portugal.

 

Orders will be delivered within 24 / 48 hours (in Mainland Spain and Portugal) after the purchase is confirmed, provided they are made before 17:00 on weekdays (from Monday to Friday).

For orders placed after 13:00 hours or on Saturdays or holidays, the order will be processed on the next business day.

Orders will be delivered within a period of 3 to 6 days after the purchase is confirmed.

10. If you are not satisfied, we will refund your money

Customer satisfaction is the primary goal of yellowshop.es, therefore, if you are not satisfied with the purchased product, your money will be refunded or a voucher will be generated.

Returns will be FREE as long as they are made in one of our physical stores.

yellowshop.es reserves the right to reject returns that do not include the identification label or the original brand box.

The Seller will only accept returns of products that are unused and in the same condition in which they were delivered.

Shipping and/or cash on delivery costs for the returned order will never be refunded.

The maximum period for the refund of the amount paid by the consumer for the products is 14 calendar days from the withdrawal and conditioned, where appropriate, on the return of the product delivered. The consumer has the right to recover the sums paid, without any delay, in case of non-execution due to unavailability.

11. Force Majeure

In cases of force majeure that hinder the delivery of the products, the Seller will have the right to delay it and in the case that such circumstances persist for more than 15 days to cancel the orders without obligation of compensation in any case. Cases of force majeure will include, among others: strikes, lack of transportation, accidents in warehouses, fires, and in general all those causes independent of the will of the Seller.

12. Treatment of packages not delivered by the logistics service.

These are packages that have not been delivered to the final recipient for the following reasons: the recipient is unknown because they do not live at the indicated address, they are absent, or the shipment is rejected. The packages are returned to yellowshop.es.

In the case that the recipient is absent, the Delivery Service will leave a notification indicating that they have passed by and will return.

In the case that the delivery address is incorrect, the recipient is repeatedly absent or refuses the shipment, the packages will be returned to our logistics warehouse. In such a case, you will be notified via email of the incident, and a voucher code for the same amount of the undelivered shipment will be sent to you. The customer may request the cancellation of the voucher and the refund of the amount by contacting our customer service at atc@yellowshop.es

YELLOWSHOP.ES does not commit to reserving items that are returned to our facilities, but it does commit to refunding the money for them.

13. Liability

yellowshop.es is not responsible for the misuse that customers may make of the system. Likewise, it will not assume any responsibility in case of anomaly in the provision of the service, external intrusions, or computer viruses. It will also not be liable in cases of force majeure listed above nor in the case of unforeseeable circumstances. Customers benefit from the warranties that the brands present on the site have granted. Yellowshop.es is not responsible for the damage suffered by the products delivered due to the inappropriate use of them.

14. Intellectual Property

Both the yellow brand and its logo and the design of the page, photos, text, sound, and underlying programming are protected by intellectual property laws. Their partial or total copying or disclosure is completely prohibited. Its property is exclusive to yellowshop.es or its subsidiaries.

15. Contests

Periodically, the Seller will organize contests with free participation in which discount vouchers can be raffled or directly offered items or others not corresponding to its commercial offer.

Gift vouchers will not be cumulative with other offers and will have a validity to be determined according to the contest. Yellowshop.es reserves the right to publish the data of the winning contestants.

16. Discount Vouchers

Discount vouchers can be obtained in various ways, including: requesting a voucher when returning a product, winning a contest, special promotions from yellowshop.es for filling out surveys, registering for the Newsletter service, etc...

Discount vouchers will be entered in the box indicated during the purchase process before payment.

If the amount of the discount voucher is less than the amount of the selected product/s, the remaining amount must be paid.

17. Warranty

In case of a defective product, the seller must proceed, as appropriate, with the repair, replacement, reduction of the price, or termination of the contract, actions that will be free of charge for the consumer and user.

The seller is liable for any lack of conformity that becomes apparent within two years of delivery.

The consumer and user must inform the seller of the lack of conformity within two months of becoming aware of it.

18. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution, which is available at the following link: https://ec.europa.eu/consumers/odr/.

Consumers will be able to submit their claims through the online dispute resolution platform.

19. Reservation of Rights

YellowShop reserves the right to refuse returns sent or communicated outside the fixed time limit, or items that are not in the same condition in which they were delivered.
