This Policy explains how your personal information is collected, used, and disclosed by Workspot.<\/p>\n This Privacy Policy (\u201cPrivacy Policy<\/strong>\u201c) explains how information is collected, used and disclosed by Workspot Inc., a Delaware corporation (\u201cWorkspot<\/strong>\u201c, \u201cwe<\/strong>\u201d, or \u201cus<\/strong>\u201d), and applies to information we collect when you use or access our online or mobile websites (www.workspot com), products, services or applications (collectively, the \u201cWorkspot Services<\/strong>\u201c), or when you otherwise interact with us. We respect the privacy rights of users and recognize the importance of protecting information collected about you.<\/p>\n WHAT WE COLLECT<\/strong><\/p>\n We collect information from you in various ways when you use our website or correspond with us via communication services, such as email and social media. We may collect personal information that you directly enter on our website or send to us via communication services. Information we may collect includes name, email address, title, phone number, address, and company. In addition, when you visit our website some information may be automatically collected. For example, it is standard for your web browser to automatically send information to every website you visit including ours. That information includes your computer\u2019s Internet Protocol (IP) address, access times, browser type and language, and referring website addresses. We may also collect information about your computer\u2019s operating system and information about your usage and activity on our website. We use this information, which does not identify individual users, to administer the site, to track users\u2019 movements around the site or hosted service, to improve our products and services, and for internal recordkeeping as a whole. For example, we may use the information we collect from you on our website:<\/p>\n \u25cf to register you for an account with us to use the Hosted Service (Workspot Control) or Workspot Client Application; Workspot may store and process personal information in the United States and other countries.<\/p>\n <\/p>\n SHARING OF PERSONAL INFORMATION\u00a0<\/strong><\/p>\n We use third parties such an email service provider to send out emails on our behalf. When you sign up for our products or services, we will share the personal information you provide only as necessary for the third party to provide that service. These third parties are obligated to protect your information. We do not sell your personal information to third parties. If this practice should change in the future we will update this policy and provide individuals with opt-out or opt-in choice as appropriate prior to sharing their personal data.<\/p>\n We do not share your personal information with third parties other than as described in this privacy policy above and as follows:<\/p>\n \u25cf with third party vendors, consultants and other service providers (\u201cService Providers\u201d) who are working on our behalf and need access to your information to carry out their work for us; \u00a0<\/strong><\/p>\n INTERNATIONAL TRANSFERS<\/strong><\/p>\n As part of its GDPR compliance program, Workspot now requires a data processing agreement with its data controllers containing the EU\u2019s Standard Contractual Clauses which covers the collection, use, retention and processing of personal information transferred from the European Union to the United States.\u00a0 Any questions regarding Workspot\u2019s GDPR compliance should be submitted to privacy@workspot.com<\/a>.<\/p>\n EU, UK and Swiss individuals with GDPR complaints also have the right to contact their local data privacy authority (DPA) or the Swiss Federal Data Protection and Information Commissioner (FDPIC).\u00a0 Please follow the links below for more information regarding these options:<\/p>\n Swiss Individuals \u2014\u00a0https:\/\/www.edoeb.admin.ch\/edoeb\/en\/home\/the-fdpic\/links\/data-protection\u2014switzerland.html<\/a><\/p>\n EU Individuals \u2014\u00a0https:\/\/edpb.europa.eu\/about-edpb\/about-edpb\/members_en<\/a><\/p>\n UK Individuals \u2014\u00a0https:\/\/ico.org.uk\/<\/a><\/p>\n Data subjects and data protection supervisory authorities in the EU may also contact our data protection representative according to Article 27 GDPR.<\/p>\n \u00a0<\/strong><\/p>\n DATA PRIVACY FRAMEWORK <\/strong><\/p>\n Workspot, Inc. complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce.\u00a0 Workspot has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. Workspot has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF.\u00a0 If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and\/or the Swiss-U.S. DPF Principles, the Principles shall govern.\u00a0 To learn more about the Data Privacy Framework Program (DPF Program), and to view our certification, please visit https:\/\/www.dataprivacyframework.gov\/.<\/p>\n Our participation in the Data Privacy Framework applies to all personal data that is subject to this Privacy Policy and which is received from\u00a0the European Union, European Economic Area, United Kingdom, and Switzerland. We will comply with the Data Privacy Framework Principles in respect of such personal data.<\/p>\n In certain situations, we may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.<\/p>\n If you are an EU, UK, or Swiss Individual, where we transfer your personal data to third party service providers who perform services for us or on our behalf, we are responsible for the processing of that data by them and shall remain liable if they process your personal data in a manner inconsistent with the DPF Principles, unless we prove that we are not responsible for the event giving rise to the damage.<\/p>\n We acknowledge that pursuant to the DPF Program, EU, UK and Swiss individuals have the right to access their data that is transferred into the United States.\u00a0 Data subjects can also update, amend or change inaccurate information and request deletion of data that is found to have been processed in violation of the Data Privacy Framework Principles.\u00a0 Individuals wishing to exercise this right may do so by emailing us at privacy@workspot.com.<\/p>\n We will provide an individual opt-out choice, or opt-in for sensitive data, before we share your data with third parties other than our agents, or before we use it for a purpose other than which it was originally collected or subsequently authorized. To request to limit the use and disclosure of your personal information, please submit a written request to privacy@workspot.com.<\/p>\n We encourage all European individuals (including Swiss and United Kingdom individuals) to contact us should you have a GDPR or Data Privacy Framework-related (or general privacy-related) complaint at privacy@workspot.com.<\/p>\n In compliance with the EU-US Data Privacy Framework Principles, Workspot commits to resolve complaints about your privacy and our collection or use of your personal information transferred to the United States pursuant to the DPF Principles.\u00a0 European Union, Swiss and United Kingdom individuals with DPF inquiries or complaints should first contact Workspot by email at privacy@workspot.com.<\/p>\n Workspot has further committed to refer unresolved DPF Principles-related complaints to a U.S.-based independent dispute resolution mechanism, BBB NATIONAL PROGRAMS. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed by us, please visit www.bbbprograms.org\/dpf-complaints<\/a> for more information and to file a complaint. This service is provided free of charge to you.<\/p>\n If your DPF complaint cannot be resolved through the above channels, under certain conditions, you may invoke binding arbitration for some residual claims not resolved by other redress mechanisms. See\u00a0 https:\/\/www.dataprivacyframework.gov\/framework-article\/ANNEX-I-introduction<\/a> for more information on this process.<\/p>\n With respect to personal data received or transferred pursuant to the DPF Program, Workspot is subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission.<\/p>\n \u00a0<\/strong><\/p>\n CALIFORNIA CONSUMER PRIVACY ACT<\/strong><\/p>\n Effective on January 1, 2020, the California Consumer Privacy Act (CCPA) allows California residents to obtain certain information collected by the business with whom they have an established business relationship.\u00a0 If you are a California resident, you may exercise certain rights to access, restrict, or delete your personal information by submitting a request to\u00a0privacy@workspot.com<\/a>.<\/p>\n TRACKING TECHNOLOGIES<\/strong><\/p>\n Tracking technologies such as: cookies, beacons, tags and scripts are used by Workspot, our website analytics and service partners such as Google Analytics, HubSpot or Salesforce. These technologies are used in analyzing trends, administering the site, tracking users\u2019 movements around the site and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.<\/p>\n We use cookies for saving users\u2019 settings, improving navigation, and to provide more relevant information on our website. Users can control the use of cookies at the individual browser level. If you reject cookies, you may still use our site, but your ability to use some features or areas of our site may be limited.<\/p>\n We gather certain information automatically and store it in log files. This information may include Internet Protocol (IP) addresses, browser type, Internet Service Provider (ISP), referring\/exit pages, operating system, date\/time stamp, and\/or clickstream data. We may combine these log files with other information we collect about you.
