An eligible elector who believes that a candidate or registered third party advertiser has contravened the election campaign finance rules under the Municipal Elections Act, 1996 may apply for a compliance audit of their campaign finances.

To apply for a compliance audit of a councillor candidate, mayoral candidate, or registered third party advertiser:

  1. Complete the Compliance Audit Application form
  2. Submit the form and any supporting documents by the deadline (below) and email to candidateinfo@toronto.ca.

Compliance audit applications are accepted for a 90 day period following candidate financial filing deadline(s).

For the 2023 by-election for Mayor, the City Clerk must receive the compliance audit application by the following dates:

  • For the initial financial filing deadline of September 11, 2023, the City Clerk must receive the compliance audit application form by December 11, 2023.
  • For the supplementary financial filing deadline of March 13, 2024, the City Clerk must receive the compliance audit application form by June 11, 2024.
  • For financial statements filed during the 30-day grace period or a court-ordered extension, the City Clerk must receive the compliance audit application within 90 days of when the financial statement was filed.

For the 2023 by-election for Councillor, Ward 20 – Scarborough-Southwest, the City Clerk must receive the compliance audit application by the following dates:

  • For the initial financial filing deadline of February 13, 2024, the City Clerk must receive the compliance audit application form by May 13, 2024.
  • For the supplementary financial filing deadline of August 14, 2024, the City Clerk must receive the compliance audit application form by November 12, 2024.
  • For financial statements filed during the 30-day grace period or a court-ordered extension, the City Clerk must receive the compliance audit application within 90 days of when the financial statement was filed.

For the 2024 by-election for Councillor, Ward 15 – Don Valley West, the City Clerk must receive the compliance audit application by the following dates:

  • For the initial financial filing deadline of January 20, 2025, the City Clerk must receive the compliance audit application form by April 21, 2025.
  • For the supplementary financial filing deadline of July 21, 2025 the City Clerk must receive the compliance audit application form by October 20, 2025.
  • For financial statements filed during the 30-day grace period or a court-ordered extension, the City Clerk must receive the compliance audit application within 90 days of when the financial statement was filed.

The Compliance Audit Committee will consider the application and, if granted, will appoint an auditor to audit the campaign finances. The Committee will consider the audit results and decide whether to commence legal action.

Please note that in addition to the compliance audit process, any person may pursue their own legal action in relation to the election. A prosecution related to the 2022 municipal election or any by-election during the 2022-2026 term of office must be commenced on or before November 14, 2026.
