BISMARCK – North Dakota’s state veterinarian says the state’s first reported case of anthrax this year is a reminder to livestock producers to take action to protect their animals from the disease, especially in areas with a past history of the disease. The case included beef cows from Adams County and was confirmed yesterday by the South Dakota Animal Disease Research and Diagnostic Laboratory.

BISMARCK, N.D. – This week, adult emerald ash borers (EAB) were collected from a trap placed in LaMoure County, nine miles north of Edgeley, North Dakota. Upon follow-up from North Dakota Department of Agriculture (NDDA) staff, additional larvae were collected and have been officially confirmed as EAB. The detection is the first in North Dakota, and it becomes the 37th state to detect EAB.

BISMARCK, N.D. – Retailers are encouraged to do their due diligence on current inventory and before ordering hemp-derived products to sell at their businesses. Hemp-derived cannabinoid products such as cannabidiol (CBD) and cannabigerol (CBG) that meet the intent of the law will continue to be allowed until there is further action by the Food and Drug Administration (FDA); however, tetrahydrocannabinol (THC) products that induce psychotropic effects are not allowed in the state.

BISMARCK, N.D. – Anhydrous ammonia nurse tank owners are urged to check the manufacturer and manufacture date of their nurse tanks after a safety advisory was issued by the Federal Motor Carrier Safety Administration and the Pipeline and Hazardous Materials Safety Administration about the possibility of catastrophic tank failure. Tanks made by the American Welding and Tank (AWT) Company in Fremont, Ohio, between Jan. 1, 2007, and Dec. 31, 2011, have had integrity issues with the welding and may rupture.

BISMARCK – The Environmental Protection Agency (EPA) issued an order today allowing existing stocks of over-the-top Dicamba to be used in 2024. Existing stocks refers to those stocks of previously registered pesticide products that are currently in the United States and were packaged, labeled, and released for shipment prior to Feb. 6, 2024.

BISMARCK – A ruling by the U.S. District Court of Arizona in Tucson on Tuesday has vacated the 2020 registrations for three Dicamba products used in over-the-top applications on Dicamba-tolerant soybeans. The ruling states that the U.S. Environmental Protection Agency (EPA) unlawfully approved the use of Bayer Xtendimax, BASF Engenia and Syngenta Tavium by failing to follow notice and comment mandates for the products.

BISMARCK, N.D. – The North Dakota State University Veterinary Diagnostic Laboratory has confirmed the presence of highly pathogenic avian influenza (HPAI) in a commercial turkey and chicken flock in Ransom County, North Dakota. The detection extends the suspension of poultry/bird events in Ransom and the adjoining counties of Barnes, Cass and Richland, which were currently under suspension from a late August finding in Cass County. Adjoining counties newly under suspension due to the Ransom County finding are Sargent, Dickey and LaMoure. Additional counties still under suspension from earlier findings include Traill, Steele, McLean, McHenry, Ward, Mountrail, Renville and Burke.

BISMARCK, N.D. – The North Dakota State University Veterinary Diagnostic Laboratory has confirmed the presence of highly pathogenic avian influenza (HPAI) in a non-commercial, backyard flock in Ward County, North Dakota. Effective immediately, following the detection of highly pathogenic avian influenza (HPAI), comingling events such as poultry and bird shows, sales and swaps are prohibited in the affected county and adjoining counties.

BISMARCK – Palmer amaranth (Amaranthus palmeri) has been confirmed in Hettinger County. The finding consisted of several plants, and it appears the seeds came from a custom harvest crew from the previous year. It was confirmed as Palmer amaranth by the National Agricultural Genotyping Center. The producer reported the suspect plants, which were then removed and destroyed.

Pre-harvest desiccation refers to an herbicide application that dries the plant and leaves of a crop before harvest.

BISMARCK, N.D. – Agriculture Commissioner Doug Goehring strongly opposes the Environmental Protection Agency’s (EPA) current pattern of severely restricting or banning applications of safely-used critical agricultural chemicals.

BISMARCK – Palmer amaranth (Amaranthus palmeri) has been confirmed just inside Traill County. The finding consisted of two plants on the side of the road that were very close to an existing infestation just over the county line in Cass County. A sample was taken; however, verification of the exact location by a local weed control officer was unable to be completed. The sample was submitted for DNA analysis to the National Agricultural Genotyping Center, where it was confirmed as Palmer amaranth.

BISMARCK – The North Dakota Department of Agriculture (NDDA) Soil Health Cover Crop Grant Program is now open for applications. The program was made possible through funding provided by the 67^th Legislative Assembly. NDDA will provide cost-share assistance to producers.

BISMARCK – The State Board of Animal Health has rescinded the temporary ban of poultry events and exhibitions, effective immediately.  This ban was first enacted as animal health officials responded to cases of Highly Pathogenic Avian Influenza (HPAI) across the state this spring. It was extended in June as cases continued and officials felt these types of poultry events could pose a risk of HPAI transmission.  With the warmer summer weather and bird migrations slowing around the state, the risk of HPAI spreading in the environment has decreased.  Agriculture Commissioner Doug Goehring shares, “We understand the challenges our small and large poultry producers faced this spring.  Rescinding the ban provides an opportunity for our youth and backyard flocks to once again participate in activities and public sales.”

A presumptive positive case was first identified by the North Dakota State University Veterinary Diagnostic Laboratory and confirmed by the APHIS National Veterinary Services Laboratories in Ames, Iowa.

BISMARCK, N.D. – The confirmation of highly pathogenic avian influenza (HPAI) in 56 hunter-harvested wild waterfowl as part of the United States Department of Agriculture’s ongoing surveillance program in North and South Carolina over the past two weeks is a reminder to poultry owners to increase biosecurity. The strain, a Eurasian H5N1 HPAI, is related to the strain of HPAI that Europe and the Middle East have been fighting in recent months and had not been detected in a wild bird in the United States since 2016.

BISMARCK – The United States Court of Appeals for the Ninth Circuit issued a ruling yesterday that immediately banned the registrations of Xtendimax, FeXapan and Engenia, products used in over-the-top applications on Dicamba-tolerant soybeans and cotton. This ruling was based on a determination that the continued registration of the products violated the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). It immediately bans the sale and use of these products nationwide.

Goehring speaks at Sen. Cramer’s WOTUS roundtable

BISMARCK – Agriculture Commissioner Doug Goehring spoke today at a Waters of the United States (WOTUS) Rule roundtable in Bismarck attended by U.S. Environmental Protection Agency Administrator Andrew Wheeler and hosted by Sen. Kevin Cramer.

Goehring spoke of the impact the 2015 rule would have had on North Dakota. “Under the previous definition of a traditionally navigable water (TNW), there were only 5,100 linear miles of jurisdictional TNWs in North Dakota,” Goehring said. “The 2015 rule would have expanded federal authority to 85,604 linear miles in North Dakota.”

Goehring said that North Dakota, as a prairie pothole state, would have witnessed federal jurisdiction over 80 percent of the state.

The EPA finalized a repeal of the 2015 Waters of the United States (WOTUS) rule last month. A WOTUS rewrite has been underway since December of 2018 and the proposed rule is expected to be finalized later this year.

“Unlike the 2015 rule, the currently proposed rule was crafted with better input from stakeholders,” Goehring said. “We welcome the clarity and certainty a final rule will provide for states and landowners.”
