THE TERMS OF THE REFERRAL PROGRAM (“TERMS”) SUPPLEMENT AND ARE INCORPORATED BY REFERENCE IN MISTERB&B’S TERMS OF USE AND PRIVACY POLICY. MISTERB&B’S TERMS OF USE AND PRIVACY POLICY ALSO APPLY TO THIS REFERRAL PROGRAM. YOU MUST AGREE TO THESE TERMS IN ORDER TO PARTICIPATE IN THE REFERRAL PROGRAM. IF THERE IS A CONFLICT BETWEEN THESE TERMS AND ANY PROVISIONS OF MISTERB&B’S TERMS OF USE, THE CONFLICTING TERMS IN THESE TERMS CONTROL WITH RESPECT TO THE REFERRAL PROGRAM. WE RESERVE THE RIGHT TO ANY REMEDY, INCLUDING, WITHOUT LIMITATIONS, DENIAL OF PAYOUTS OR ACCOUNT TERMINATION, IF WE DETERMINE OR SUSPECT YOU HAVE BREACHED ANY OF THESE TERMS OR MISTERB&B GENERAL TERMS AND CONDITIONS.
Capitalized terms that are not defined here will have the same meaning given to them in the misterb&b Terms of Use.
1. Earn Referral Rewards.
As a Member, you may earn Travel Credits for each individual that you refer as a Guest or Host to misterb&b, for which a Qualifying Referral (defined below) is completed. The Travel Credits that are issued by misterb&b pursuant to this Referral Program (a “Referral Reward”) may be applied as credits toward future confirmed bookings made by Members via the Site, App and Services. Please note that you may not be the Host or the Guest for the booking to receive a Referral Reward. You understand and accept that the determination of whether a Referral Rewards is due will be made by misterb&b in its sole discretion.
2. Qualifying Referral.
In order to receive a Referral Reward, each of the following requirements must be met in the following order (collectively, a “Qualifying Referral”):
(i) you must log into your misterb&b Account on the Site or App and select either the “Invite Friends” or “Email Your Friends” link; and
(ii) you personally must share the link provided with friends via Facebook or Twitter, by copying and pasting the unique referral link generated via the Services, by sending the unique referral link generated via the Services in an email via the Services to your friends, or by using the other tools provided by misterb&b to share the unique referral link with friends (each a “Referral Link”), each of which will contain a Travel Credit for your friend subject to the terms set forth below in “Travel Credits For Your Friends”; and
(iii) a friend who clicks the link on Facebook or otherwise, or clicks the link contained in the email, must create a misterb&b Account and become a Member; and
(iv) after becoming a Member, the friend must either (a) request a booking of a Rental Property, and related to such booking must be received a confirmed booking via the Services with a Total Value paid of at least one hundred U.S. dollars (US$100) or one hundred euros (EUR100) (or its equivalent in your local currency if we support, it, calculated from euros); or (b) create a Private Room Listing, and related to such Listing must be received a confirmed booking via the Services with a Total Value paid of at least one hundred fifty-one U.S. dollars (US$151) or one hundred fifty-one euros (EUR151) (or its equivalent in your local currency if we support it, calculated from euros). The confirmed booking must be not subsequently cancelled: the Referral Reward will be awarded to you at the first day of the friend's stay in the related booking; or at the first day of stay of a Guest that requested a booking for the related Listing the friend created.
For each Qualifying Referral, you may receive up to a maximum of two (2) Travels Credits:
(i) one (1) Travel Credit, in the amount of ten U.S. dollars (US$10) or ten euros (EUR10) (or its equivalent in your local currency if we support it, calculated from euros), in the case your friend becomes a Guest no later than four (4) months after creating a misterb&b Account; and
(ii) one (1) Travel Credit, in the amount of one hundred fifty U.S. dollars (US$150) or one hundred fifty euros (EUR150) (or its equivalent in your local currency if we support it, calculated from euros), to be used for any of your future booking on misterb&b with a Total Value paid of at leastone hundred fifty and one U.S. dollars (US$151) (or its equivalent in your local currency if we support it), in the case your friend hosts his first guest in a private room (once payout is done) no later than 5 months.
You understand that all Referred Members must be new, first time Hosts or Guests. No Travel Credits will be received by you for listings created by (i) your immediate relatives (parents, siblings, children) or member of your household, or (ii) current or former misterb&b Hosts, or bookings confirmed for current or former misterb&b Guests.
You can only obtain Referral Rewards in the limit of your first twenty (20) Qualifying Referrals under this Referral Program. Your Referral Rewards are valid within one (1) year after day of reception.
3. Sharing Referral Links With Your Friends.
It is a condition of the Referral Program that you will circulate or share the unique Referral Link only with your personal friends and not for commercial purposes. You agree not to publish or distribute the Referral Link, or cause the Referral Link to be published or distributed, on or via methods, platforms and media where you have no reasonable basis for believing that all or most of the readers or recipients are your personal friends. All misterb&b Account creations and confirmed booking requests resulting from a breach of the above will be disregarded for determining eligibility for Qualifying Referral and are not eligible for Referral Rewards.
4. Redeeming Referral Rewards.
The Referral Rewards you accrue will be displayed in your misterb&b Account profile page. Referral Rewards can be accrued solely by you and you may not earn Referral Rewards by permitting another individual to use your misterb&b Account. Referral Rewards accrued in multiple misterb&b Accounts may not be combined into one misterb&b Account. You may not earn Referral Rewards by creating multiple misterb&b Accounts. By acquiring Referral Rewards, you agree and acknowledge that misterb&b is granting you a limited, revocable license to a digital item, and that Referral Rewards are not your personal property. You may not sell Referral Rewards for real currency or obtain any cash or money in exchange for Referral Rewards. Except as explicitly provided herein, Referral Rewards are non-transferable. misterb&b’s accounting of the Referral Rewards will control if there is any dispute regarding Referral Rewards earned.
5. Travel Credits For Your Friends.
Friends that sign up for an Account through a Referral Link within seven (7) days of receipt of such Referral Link will receive a Travel Credit in the amount of ten U.S. dollars (US$10) or ten euros (EUR10) (or its equivalent converted from euros in your local currency if we support it) toward their first confirmed booking of a Rental Property via the Services; provided that such booking has a Total Value paid of at least one hundred U.S. dollars (US$100) or one hundred euros (EUR100) (or its equivalent converted from euros in your local currency if we support it).
6. Terms for Travel Credits.
The terms and conditions governing the Travel Credits, including without limitation the expiration of such Travel Credits, are available at https://www.misterbandb.com/pages/terms-and-conditions, which are incorporated by reference into these Terms.
7. Nature of relationship.
You acknowledge and agree that your participation in the Referral Program does not qualify you as an employee, intermediary or agent of misterb&b. Nothing in your participation in the Referral Program will be construed as establishing an employment or agency relationship between misterb&b and you. Accordingly, you will not represent yourself as such or give any person reason to believe you are such. You may not create materials bearing misterb&b branding or that imply any affiliation or agency relationship between misterb&b and you.
8. Member responsibility.
You represent and warrant that: (i) you have no pre-existing obligations or commitments (and will not assume or otherwise undertake any obligations or commitments) that would be in conflict with your obligations under these Terms, (ii) you will fully comply at all times with all applicable laws and you will not infringe on any third-party rights.
9. Exclusion and Limitation of Liability.
You will defend, indemnify and hold misterb&b harmless from and against all claims, damages, liabilities, losses and expenses arising out of, or resulting from, your negligence or intentional misconduct with respect to your participation in the Referral Program.
In the full extent permitted by the law, in no event will misterb&b be liable for any special, incidental, punitive, exemplary or consequential damages of any kind in connection with your participation in the Referral Program. In no event will misterb&b’s aggregate liability to you in connection with your participation in the Referral Program exceed the aggregate amount of the payments made by misterb&b to you in accordance with these Terms.
10. Suspension and Termination.
misterb&b may suspend or terminate the Referral Program or your participation in the Referral Program at any time, for any reason. misterb&b will not grant any further Referral Rewards after the suspension or termination of the Referral Program or your participation in it, but any Referral Rewards already awarded or received will not be affected by the suspension or termination. The rights and obligations of the parties under these Terms will survive the expiration or termination of the Referral Program or your participation in it.
11. Expiration.
The Referral Program will expire on January 1, 2023 or when misterb&b posts a message on this page to notify that the Program is no longer in effect. However, if the Referral Program expired or is terminated but the Host or the Guest you referred obtains, respectively their first booking or their first confirmation for a booking request, before the end of the misterb&b Referral Program, you will still receive Referral Rewards.
12. Updates to Terms.
misterb&b reserves the right, at its sole discretion, to modify these Terms, at any time and without prior notice. If we modify these Terms, we will post the change on the Site or via the App or provide you with notice of the change. We will also update the “Last Updated Date” at the top of these Terms. By continuing to participate in the Referral Program after we have posted a change on the Site or via the App or have provided you with notice of a change, you are indicating that you agree to be bound by the modified Terms. If the modified Terms are not acceptable to you, your only recourse is to cease participating in the Referral Program.
