Glad to be part of an Interesting session on "Strategies for Collective bargaining" with Dr. GP Rao and Smiti Bhatt Deorah. Collective bargaining is all about finding the right balance between competing interests and priorities. Here are a few of the key insights I've gained: Preparation is Everything: Thoroughly research the other party's interests, your own organization's goals, and the bargaining history. Focus on Interests, Not Positions: Identify common ground and explore creative solutions that address everyone's core concerns. Build Trust and Relationships: Develop personal rapport and maintain integrity throughout the process. Leverage Your BATNA: Understand your best alternative to a negotiated agreement (BATNA) - and theirs. Be willing to walk away from a bad deal. Embrace Flexibility and Creativity: Don't be afraid to think outside the box.

I recently read "My Life and Work" by Henry Ford. Probably the best book I've read this year, aside from my beloved repeat Atlas, though Francisco's money speech could easily have been based on it. IYKYK, so I digress... Along with some of my favorite shareable quotes, there is also an interesting glimpse into his evaluation of the potential for electric vehicles, which considering the time, is altogether quite insightful. Hopefully these inspire you as you celebrate Labor Day today: ·The moment one gets into the "expert" state of mind a great number of things become impossible. I refuse to recognize that there are impossibilities. I cannot discover that anyone knows enough about anything on this earth definitely to say what is and what is not possible. ·The natural thing to do is to work—to recognize that prosperity and happiness can be obtained only through honest effort. ·Now a business, in my way of thinking, is not a machine. It is a collection of people who are brought together to do work and not to write letters to one another. ·Be not bound by the present, but leave nothing to luck. ·A man ought to be able to live on a scale commensurate with the service that he renders. ·Put brains into the method, and more brains, and still more brains—do things better than ever before; and by this means all parties to business are served and benefited. ·There is no disgrace in honest failure; there is disgrace in fearing to fail.

With Closing Loopholes No. 2 receiving Royal Assent yesterday, provisions of the Act are now in effect and other provisions will commence in August of this year. Amongst all the changes, for those embarking upon, or in the midst of, enterprise bargaining negotiations, careful thought should be given to the changes made to intractable bargaining declarations, which have taken effect today. These changes, which limit the ability of the Fair Work Commission to issue workplace determinations which reduce existing entitlements in enterprise agreements, will need to be at the forefront of any bargaining strategy. The HSF team will be watching this space closely to assess the impact of these changes on bargaining in the short to medium term but there can be no doubt that the bargaining environment for all businesses is about to change! #industrialrelations #employmentlaw
