In the specific case of a tenant who consistently pays rent late, I believe that after unsuccessful attempts to mediate, it is necessary to proceed more formally. First, we should calculate the applicable late payment interest for each delayed payment, according to the terms of the lease agreement or, if not specified, in accordance with current regulations. Once the outstanding amount is determined, it may be appropriate to take legal action if the situation continues. Before reaching that point, it is advisable (here in Spain) to send a burofax to the tenant, clearly outlining the situation, and the measures that will be taken if the issue recurs. So the tenant will be properly informed of the legal consequences of his/her behavior.

It is so much better to have a tenant who is paying the rent CONSISTENTLY late as opposed to a tenant who is mostly on time for rent payments but 3-4 weeks late on occasion. In either case the best action is to meet with the tenant in person and listen to their reason for paying the rent consistently late. Most of the time the problem is that once they were behind, they could not catch up. So, the way to solve this issue is to come up with a payment plan for the late payment amount and get them on track for future payments on time. Another approach I take is to give the tenants the option to pay the rent every time they receive a paycheck. If it is weekly, pay rent weekly. If it is every 2 weeks, pay rent every 2 weeks.

Ce qui m'a vraiment servi, c'est de prendre du recul, sans jugement, et d'être flexible pour éviter des frustrations inutiles des deux côtés.
