Guidance for practitioners applying for probate or to stop a probate application using MyHMCTS.

Apply for probate

This guide describes the steps you need to take to create a probate case in MyHMCTS and make the following applications:

  • with a will (grant of probate)
  • letters of administration – without a will
  • letters of administration – with an annexed will

MyHMCTS cannot accept probate applications in all cases. In these cases, you must apply using the paper form.

Apply to stop a probate application

This guide describes the steps you need to take to apply to stop a probate application – also known as ‘raising a caveat’.

To apply, you will need:

  • an address in England or Wales where the legal papers can be sent to you
  • the full name of the person who died and any other names they were known by
  • the exact date on which they died
