Competition rules - „Red Bull competition“

(hereinafter referred to as the Rules)

 

1. THE ORGANIZER AND ORGANIZER OF THE CONSUMER COMPETITION

 

The organizer of the consumer competition called "Competition with Red Bullthe Competition”) is Delivery Hero Czech Republic s.r.o., ID: 24254398, Smrčkova 2485/4, Libeň, 180 00 Prague 8 (hereinafter referred to as the "Organizer

 

2. MECHANICS AND EVALUATION OF THE CONSUMER COMPETITION

 

  1. The condition of participation in the Competition is the purchase of a drink called Red Bull in selected restaurants, foodora shops, or at the foodora MARKET store.;
  2. Go to www.foodora.cz ("foodora Portal");
  3. Find and open the relevant section on the foodora Portal named 'Red Bull a Competition' for restaurants and/or the relevant section where it is located for foodora MARKET sellers. You can also find the relevant section here:

          (hereinafter referred to as the "Competition Section");

  1. The relevant Competition Section will show you restaurants and/or foodora MARKET selling Red Bull through which you can enter the Competition;
  2. Select and open the profile of a business located in the Competition Section, and choose any product from the restaurant's menu. Foodora shops or foodora MARKET. Then, proceed to order any Red Bull beverage.
  3. If you want to participate in the Competition, simply purchase any Red Bull beverage and you will be entered into the competition. 
  4. If you do not purchase any other items offered by the subject business, continue to the right side of the foodora Portal and click on the "Complete Order" button.
  5. Once you are redirected to the next page, select your shipping address for delivery of your order, provide your personal information, the method of payment required.
  6. By paying for an order containing a Red Bull you will automatically be entered into the Competition.
  7. Winners will be determined according to the rules described in section 5 of the contest rules. The contestant increases the probability of winning with each additional order of Red Bull, as some prizes are tied to the number of orders placed.

     

3. DATE AND LOCATION OF THE COMPETITION

 

The Competition begins on June 28th, 2024 at 00:00 a.m. and ends on July 31th , 2024 at 11:59 p.m. in the Czech Republic.

 

4. THE COMPETITION PARTICIPANTS

 

This Competition is open to all natural persons over the age of eighteen years as of the Competition Start Date who reside in the Czech Republic and who purchase a Red Bull drink during the Competition Period and comply with the Competition Rules ("Contestants").

The Competition will be automatically entered by those Contestants who fully comply with the terms and conditions set out in the Competition Rules, the terms and conditions of use of the foodora Portal at the link https://www.foodora.cz/contents/podminky-redbull-souteze  (the "Terms and Conditions"). The Competition Organizer shall have the right to make a final assessment of each Contestant's compliance with the terms and conditions of the Contest.

 

Contestants who do not comply with the Conditions of Participation or who act in breach of the Rules and/or the Terms of Use will not be entered into the Competition. If it turns out that this Contestant has become a Winner despite the above, e.g. due to false information provided by him/her, he/she is not entitled to the prize and the prize will be awarded to the Contestant who is drawn in an alternative draw.

 

5. COMPETITION PRIZES (hereinafter referred to as Prizes)

Prizes will be awarded or drawn based on the section in which the user placed their order (restaurants/shops/foodora market).

Prizes for Purchases in the Restaurants Section

A. Determining Winners Based on the Number of Orders in the Restaurants Section Containing a Red Bull Beverage:

  1. 1st - 2nd place: Two tickets (1+1) for a Meet and Greet with David Coulthard - awarded to the customers who rank 1st and to 2nd in the number of orders containing a Red Bull beverage in the Restaurants section. and having an active PRO membership 
  2. 3rd - 4th Place: Two tickets (1+1) for VIP seating + Paddock access at the Showrun event on August 17, 2024 - awarded to the customers who rank 3rd  to 3th in the number of orders containing a Red Bull beverage in the Restaurants section.
  3. 5th - 9th Place: Two tickets (1+1) for VIP seating at the Showrun event on August 17, 2024 - awarded to the customers who rank 5th to 9th in the number of orders containing a Red Bull beverage in the Restaurants section.

In the event of a tie in the number of orders for a specific position, the winner will be determined by who reached the number of orders first.

B. Determining Winners by Random Drawing from Customers Who Placed at Least One Order in the Restaurants Section:

  1. 1st Place: Two tickets (1+1) for VIP seating at the Showrun event on August 17, 2024 - determined by a random draw among customers who meet the competition conditions.
  2. 2nd - 11th Place: Merchandise - determined by a random draw among customers who meet the competition conditions.

The drawing will first select the winner, followed by subsequent winners up to the 11th place. 

The organizer specifies that the winners in section A for the Restaurants section will be determined first, followed by the drawing for winners in section B. Winners in section A are ineligible to win in section B or in other competition sections (foodora MARKET, foodora shops).

Prizes for Purchases in the Foodora Market Section

A. Determining Winners Based on the Highest Number of Orders in the foodora MARKET Section Containing a Red Bull Beverage:

  1. 1st Place: Two tickets (1+1) for a Meet and Greet with David Coulthard - awarded to the customer with the highest number of orders containing a Red Bull beverage in the foodora MARKET section and having an active PRO membership.
  2. 2nd - 3rd Place: Two tickets (1+1) for VIP seating + Paddock access for the Showrun event on August 17, 2024 - awarded to the customers who rank 2nd and 3rd in the number of orders containing a Red Bull beverage in the foodora MARKET section.
  3. 4th - 7th Place: Two tickets (1+1) for Paddock access at the Showrun event on August 17, 2024 - awarded to the customers who rank 4th and 7th in the number of orders containing a Red Bull beverage in the foodora MARKET section.

In the event of a tie in the number of orders for a specific position, the winner will determine who reached the number of orders first.

B. Determining Winners by Random Drawing from Customers Who Placed at Least One Order in the foodora MARKET Section:

  1. 1st Place: Two tickets (1+1) for VIP seating at the Showrun event on August 17, 2024 - determined by a random draw among customers who meet the competition conditions.
  2. 2nd - 11th Place: Merchandise - determined by a random draw among customers who meet the competition conditions.

  2. 2nd Place: Two tickets (1+1) for VIP seating + Paddock access at the Showrun event on August 17, 2024 - awarded to the customer who ranks 2nd in the number of orders containing a Red Bull beverage in the foodora Shops section.
  3. 3th - 5th Place: Two tickets (1+1) for Paddock access at the Showrun event on August 17, 2024 - awarded to the customer who ranks 3rd to 5th in the number of orders containing a Red Bull beverage in the foodora Shops section.

In the event of a tie in the number of orders for a specific position, the winner will determine who reached the number of orders first.

B. Determining Winners by Random Drawing from Customers Who Placed at Least One Order in the foodora Shops Section:

  1. 1st Place: Two tickets (1+1) for VIP seating at the Showrun event on August 17, 2024 - determined by a random draw among customers who meet the competition conditions.
  2. 2rd - 11th Place: Merchandise - determined by a random draw among customers who meet the competition conditions.

The drawing will first select the winner, followed by subsequent winners up to the 11th place.

The organizer specifies that the winners in section A for the Foodora Shops section will be determined first, followed by the drawing for winners in section B. Winners in section A are ineligible to win in section B or in other competition sections (restaurants, foodora Market).

6. ANNOUNCEMENT OF WINNERS

 

  • Winners will be announced within 10 working days after the end of the Competition. Each Winner of the Competition will be notified in writing within 10 working days of the end of the Competition to the email address provided in their profile on the foodora Portal in accordance with the Terms of Use.
  • Along with the information about winning the Competition, the email will also contain information regarding acceptance of the Prize.
  • If the Winner provides an invalid email or fails to respond to the prize notification within 10 working days, the Winner will forfeit their right to the Prize and a new Winner draw will take place.
  • Each Winner can only receive one prize in the entire competition. 
  • The Winner is identified by a combination of first name, last name, unique email address provided by them.
  • The prize is non-transferable.
  • The Contestant has no legal claim to the prize in the Contest.
  • The prize is not judicially enforceable.

 

7. RIGHTS AND OBLIGATIONS OF THE PROMOTER

 

The Promoter reserves the right to change the rules of the Competition, including the duration of the Competition, or to terminate or cancel the Competition at any time without refund.

The Promoter shall not be liable for non-delivery of the prize notification in the event of a change in the email account provided in the registration or in the event that the prize email could not be delivered due to circumstances caused by the Winner or third parties.

By participating in the Competition, the Contestant agrees to the Competition Rules set out by the Promoter and undertakes to fully respect and comply with them. In the event that a Contestant competes in breach of these Rules, the Promoter reserves the right to exclude such Contestant from the Competition without compensation.

The Competition is not open to employees of the Promoter, the Organiser of the Competition and their family members or relatives within the meaning of Section 771 et seq. of Act No. 89/2012 Coll.

 

8. PERSONAL DATA PROCESSING POLICY

 

The processing of personal data by the Organiser and the Competition is governed by the applicable legal regulations of the Czech Republic, in particular Regulation (EU) 2016/679 (General Data Protection Regulation), Act 110/2019 Coll. (Act on the Processing of Personal Data), Act 111/2019 Coll. (Act amending certain acts in connection with the adoption of the Act on the Processing of Personal Data) and Act No. 480/2004 Coll., (Act on Certain Information Society Services), as amended, as well as other relevant laws of the Czech legal system governing the protection of personal data.

 

The personal data controller is Delivery Hero Czech Republic s.r.o., ID No.: 24254398, Smrčkova 2485/4, Libeň, 180 00 Prague 8, registered in the Commercial Register under No. C 197771 with the Municipal Court in Prague. (hereinafter referred to as the "Administrator" or the "Organiser"). In the course of its activities, it processes the personal data of its clients, customers and participants in consumer competitions. This personal data processing policy (hereinafter referred to as the "Policy") is intended to inform the Contestants, as well as any other data subjects, about the circumstances of the processing of their personal data and the rights they have in the context of such processing. 

 

8.1 Purposes of the processing of personal data

The Administrator carries out the processing of personal data primarily, but not exclusively, for the following purposes, or areas of purposes:

  1. the conclusion and performance of contracts or the provision of services
  2. the organization of consumer competitions, their evaluation and the delivery of prizes to individual winners of consumer competitions

 

8.2 Scope of personal data processed

 

  1. The scope of the personal data processed by the Administrator varies depending on the purpose for which it is processed.
  2. For the purpose of concluding and performing the contract (or providing the services), the Administrator processes the following personal data: e-mail address, name and surname, date of birth, delivery address, telephone number, clothing size.
  3. For the purpose of organizing the Competition, its evaluation and delivery of the Prizes to the individual Competition Winners, the Administrator processes the following personal data: e-mail address, name and surname, date of birth, delivery address and telephone.
  4. The Administrator declares that no automated decision-making operations involving interference with the rights or legitimate interests of the Contestants are carried out during the processing.

 

8.3 Voluntary provision of personal data

 

The Contestant provides his/her personal data to the Administrator voluntarily. However, the failure to provide personal data may affect the Administrator's ability to provide the data subject with services based on the necessary knowledge of the required information about the Contestant, including personal data within the meaning of the applicable legal regulations of the Czech Republic.

8.4 Duration of processing of personal data

 

For the purpose of concluding and performing the contract, the Administrator processes personal data for the period necessary for the conclusion and performance of the contract, in particular for the period of providing the service, including the warranty period and subsequent archiving based on the legal obligation within the meaning of the applicable legal regulations of the Czech Republic.

For the purposes of organizing the Competition, its evaluation and delivery of the Prizes to the individual Winners of the Competition, the Administrator processes personal data for a period of time appropriate for this purpose, but no longer than 3 years.

For the purposes of sending commercial communications and for marketing and advertising purposes, the Administrator processes personal data for a period of time necessary and appropriate for these purposes, but no longer than 3 years.

 

8.5 Recipients of personal data

 

The personal data obtained by the Administrator from the Contestant in connection with participation in the Competition is shared by the Administrator with the companies cooperating in the implementation of the Competition ("Cooperating Companies") in the context of this Contest, each of these Cooperating Companies continuing to act as a separate controller in relation to the personal data submitted.

8.6 Method of processing personal data

 

The Controller, the Cooperating Companies and any processors of the Administrator process personal data manually (in printed and electronic form) and electronically by usual automated means.

 

8.7 Rights of data subjects to access personal data

 

The Contestant has the right to obtain, upon request, confirmation from the Administrator as to whether or not personal data relating to him/her is being processed and, if so, the right to access such personal data to the following extent of information (even if he/she has already been informed of such information by the Administrator when registering for the Competition on the "PERSONAL DATA PROCESSING POLICIES" page as part of the registration process for the Contest):

  1. What are the purposes of the processing.
  2. What are the categories of personal data.
  3. An overview of the recipients or categories of recipients to whom his/her personal data have been or will be disclosed, in particular recipients in third countries or international organizations.
  4. What is the intended period for which the personal data will be retained or, if this is not possible to determine, the criteria used to determine the retention period.
  5. What are his/her rights. In particular, the right to request from the Administrator the rectification or erasure of personal data relating to the data subject or the restriction of their processing, or to object to such processing.
  6. The right to lodge a complaint with a supervisory authority.
  7. Any information about the source of the personal data, unless obtained directly from the data subject.

 

The Competitor also has the right to request from the Administrator a copy of the personal data processed, provided that the rights and freedoms of other data subjects will not be adversely affected. For repeated frequent requests from the data subject, the Controller may charge a reasonable fee equal to the justifiable administrative costs of their acquisition. If the Competitor submits a request electronically, the information will also be provided to the Competitor electronically in a machine-readable format, unless the Competitor requests a different method of delivery.

 

Right to correction

The Contestant has the right to have inaccurate personal data concerning him/her corrected by the Administrator without undue delay. Taking into account the purposes of processing and the rules of the Competition, the Contestant also has the right to have incomplete personal data completed.

 

Right to erasure (right to be forgotten)

The Contestant has the right to have the Administrator delete all of his/her personal data concerning him/her without undue delay and the Administrator is obliged to delete the personal data without undue delay if one of the following reasons is given:

  1. The personal data are no longer necessary for the purposes for which they were collected or processed
  2. The competitor withdraws the consent on the basis of which the personal data was processed and there is no further legal basis for the processing.
  3. The competitor objects to the processing of personal data for direct marketing purposes.
  4. The personal data is processed unlawfully.
  5. The personal data must be erased to comply with a legal obligation under the law.
  6. The personal data was originally collected in connection with the offer of information society services on the basis of consent given by the child.

 

Right to restriction of processing

The Contestant has the right to have the Administrator restrict processing in any of the following cases:

  1. The Contestant objects to the accuracy and timeliness of his/her personal data, and only for the time necessary for the Administrator to verify the accuracy of the personal data. In such a case, the Contestant shall provide reasonable cooperation in order to clarify the data.
  2. The processing is unlawful and the Contestant refuses the erasure of the personal data and requests instead the restriction of its use.
  3. The personal data is no longer necessary for the purposes of processing by the Controller, but is required by the Competitor for the establishment, exercise or defense of legal claims.

 

Right to portability of personal data

The Contestant has the right to obtain personal data concerning him/her in a structured, commonly used, machine-readable format and the right to transfer such data to another controller without hindrance from the Administrator, provided that the processing is based on consent to the processing of personal data or the processing is for the purpose of entering into and performing a contract with the Contestant and the processing is carried out by automated means and the data has been transmitted/communicated to the Administrator by the Contestant.

The right of portability of personal data must not adversely affect the rights and freedoms of other persons.

 

Right to object

Where personal data are processed for direct marketing purposes, the Contestant has the right to object at any time to the processing of personal data concerning him/her for this purpose, which includes profiling (i.e. any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to the data subject), insofar as it relates to such direct marketing

 

If the Contestant objects to processing for direct marketing purposes, the personal data will no longer be processed by the Administrator for these purposes. However, the Contestant acknowledges that the cessation of the processing of his/her personal data for marketing purposes may, in exceptional cases, lead to the termination/limitation of his/her participation in the Competition and thus limit his/her possibility of winning the Prize.

 

The right not to be subject to automated decision-making

 

The Contestant has the right not to be subject to any decision based solely on automated processing, including profiling (i.e. any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to the data subject), which may have legal effects on the Contestant or affect the Contestant in a similarly significant way. This right does not apply if the automated decision is necessary for the conclusion or performance of a contract between the data subject and the Administrator or is based on the data subject's explicit consent. However, in such a case, the Contestant has the right to human intervention in the automated decision by the Administrator, the right to express his/her point of view and the right to Competition the automated decision.

 

Exercise of the right

 

The Contestant may exercise his/her rights at any time by sending an electronic message to [email protected], by using the link provided in any commercial communication sent in the framework of the Contest, or by sending a written revocation of consent to the address of Delivery Hero Czech Republic s.r.o., ID No.: 24254398, Smrčkova 2485/4, Libeň, 180 00 Prague 8, whereby it is up to the Contestant to choose the most acceptable form of revocation.

 

For the purpose of sufficient identification in the event of withdrawal of consent, it is necessary to provide the email address used in the registration form and the name of the Competition as part of the withdrawal.

 

In the event of withdrawal of consent, the processing of personal data carried out by the Administrator on the basis of another legal title, in particular for the purpose of performance of a contract, or the lawfulness of processing based on consent up to the moment of its withdrawal by the Contestant, shall not be affected.

 

Right to lodge a complaint with a supervisory authority

 

The Contestant has the right to lodge a complaint against the processing of his/her personal data by the Administrator with the supervisory authority for the Czech Republic:

9. COMPETITION RULES, APPLICABLE LAW

 

  • The full rules of the Competition are available on the Competition website at www.foodora.cz for the duration of the Competition.
  • This Competition and legal relations arising from these rules are governed by the law of the Czech Republic as amended on the date of their publication.
  • By purchasing a Red Bull product, each Contestant accepts these rules and other instructions as set out in these Competition Documents on the Competition Site.
