At Kenrise Media Private Limited, conducting business as The Ken ("Company"), we are committed to respecting the privacy rights of all visitors/users to our website: the-ken.com ("Website") and our application ‘The Ken’ (“Ken Application”) and together with the Website, the “Platform”). Through our Platform, the Company allows users to subscribe to exclusive journalistic content on the payment of a subscription fee ("Services"). Your privacy is important to us and we aim for our Services to be a safe and enjoyable environment for our audience. We respect and safeguard the personally identifiable information, i.e. information that either by itself or in association with other information available with us serves to identify you (“Personal Information”), which we receive and collect from you on our Platform and in the course of our other interactions online.

Please note that this Privacy Policy (“Policy”) is only applicable to the users of our Platform, and the information and data gathered therefrom, and not to any other information or website. You are hereby advised to read this Policy carefully and fully understand the nature and purpose of gathering and/or collecting sensitive, personal and other information and the usage, disclosure and sharing of such information. By viewing or accessing the Platform and/or subscribing to the Services, you hereby also consent to the Company sharing information with third party service providers engaged by the Company in relation to its operations and to the transfer and/or storage of Personal Information and data across borders. In addition, your use of the Services shall be subject to the notices, terms, and conditions set forth in this Policy and the Terms and Conditions as available at: the-ken.com/terms-and-conditions (“Terms”).

1. This Policy explains:

  • how we will protect and use information we collect about and from you;
  • the circumstances in which we might disclose your details to anyone else;

2. Information Gathered

In general, you can visit our Platform without revealing your identity or any Personal Information about yourself. However, you may not be able to access certain areas or Services that require registration, subscription, or need you to reveal your identity and/or other information about you. In particular, you may not be able to access premium journalistic content without subscribing to the Services and accepting the terms and conditions applicable thereon. Please note that minors are prohibited from using the Services and the Company is committed to not collecting Personal Information from any minors viewing the Platform.

Information that we collect from you may include your username, name, age, email address, place of residence and phone number. In addition, we may collect demographic information such as information about your computer, location (through GPS), hardware, software, platform, media, Internet Protocol (IP) address and connection, information about online activity such as feature usage and click paths, passwords and other data that you may provide in surveys or online profiles. We may combine demographic information with Personal Information to tailor our offerings or web pages, including advertising subject matter, to your preferences or interests.

3. Personal Information

Personal Information means any information that may be used to identify you and that is not otherwise publicly available, including, but not limited to, your gender, first and last name, email address, phone number, place of residence or other contact information.

We collect Personal Information from you when you register on the Platform and subscribe to the Services or otherwise voluntarily chose to contact us and provide such information. When you register with the Platform, we will collect certain Personal Information from you in order to provide you with a user account to utilize the Services.

4. Cookies and Other Tracking Technologies

Some of our web pages and Services may also utilize “cookies” and other tracking technologies. A “cookie” is a small text file that may be used, for example, to collect information about your activity on our Platform. Some cookies and other technologies may serve to recall Personal Information previously indicated by you. Tracking technologies may automatically record information such as Internet domain and host names; other information about your geographic location; IP addresses; browser software and operating system types; CPU type; your manner of connecting to the Internet (e.g., connection speed through narrowband or broadband access); click paths; dates and times that our Platform is accessed; and duration of use of our Services.

Our use of cookies and other tracking technologies allows us to improve our Platform and Services and consequently your experience with the same. We may also analyze information that does not include Personal Information for trends and statistics.

5. User Data Deletion and Retention

You can access, amend and remove your Personal Information and other information we have received and collected from you to provide the Services. Should you choose to delete your user account, please contact us at [email protected], and we will tend to such a request as soon as possible.

Upon deletion of your user account, please note that we may no longer be able to provide you with our Services. Notwithstanding the deletion of your account, we may retain one copy of your Personal Information for such a period as reasonably necessary to comply with any legal, regulatory, tax, accounting or reporting requirements which apply to us. Any user information retained by us for Service improvement and development, shall be anonymized and shall not be utilised to specifically analyse personal characteristics about you.

6. Uses of Personal Information

We may use Personal Information and other information received and collected from you to provide the Services you have requested, including for the purpose of sending you updates or to contact you upon your request and when otherwise necessary. We may also use Personal Information for auditing, research and analysis, and to operate and improve our Services. In certain circumstances, we may share aggregated non-personal information with third parties. In certain limited instances, Personal Information that you provide towards creation of a publicly visible profile on our Platform may be indexed by search engines (such as www.google.com and www.bing.com) and may appear in search results on such search engines. When we use third parties to assist us in processing your Personal Information, we require that they comply with our Policy and any other appropriate confidentiality and security measures. We may also share such information with third parties in limited circumstances, including when complying with legal process, preventing fraud or imminent harm, and ensuring the security of our network and Services.

Unless otherwise agreed, where we propose to use your Personal Information for any other uses we will ensure that we notify you first. You will also be given the opportunity to withhold or withdraw your consent for your use other than as listed above. However, the withdrawal of consent shall not prejudice any processing undertaken based on consent before its withdrawal.

You have the right to rectification if you believe that the Company has stored wrong or incomplete Personal Information about you.

7. Confidentiality and Security

We will keep confidential and protect your Personal Information except where disclosure is required or permitted by law.

We follow generally accepted industry standards to protect the Personal Information submitted to us, both during transmission and, once we receive it, for storage and disposal. When you enter sensitive information on our registration or order forms, we encrypt that information using secure socket layer technology (SSL). All information we gather is securely stored within databases controlled by us. The databases are stored on servers secured behind a firewall; access to the servers is password-protected and is strictly limited. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

We limit access to Personal Information to employees, agents, advisors and consultants who we believe reasonably need to come into contact with that information to provide products or Services to you or in order to do their jobs.

We may provide information, including Personal Information, to third-party service providers to help us deliver our products, information, and Services efficiently and effectively. If you choose to provide us with your Personal Information, we may transfer that Personal Information from your country or jurisdiction to other countries or jurisdictions around the world. Your Personal Information may be collected and stored on servers located in the territory of India and such other countries as we may disclose from time to time.

8. Third Party Websites

If you click on a link to a third-party site or otherwise leave the Platform, you will go to a website that is outside the purview of our control. Because we cannot control the activities of third parties, we cannot accept responsibility for any use of your Personal Information by such third parties, and we cannot guarantee that they will adhere to the same privacy and security practices as we do. The use of Personal Information by such websites shall be governed by the privacy policies and terms and conditions provided therein. Therefore, if you visit a third party website that is linked to our Platform, you should consult that website's privacy policy before providing any Personal Information.

9. Payment and Billing Information

When you purchase a subscription for the Services, using one or more of our payment gateway service providers, or any other online or mobile payment services provider we may use (including through any app stores), payment information that may be collected from you include, but are not limited to credit/debit card details (number, card expiry date, CVC code) or other bank account details along with the date, time and amount of the transaction payment. This payment information is stored by our payment processors and associated with a customer name/ID and location which our payment processor gives to us, together with a unique customer ID which we share with them, but this payment information is never stored or processed by us. Our payment processors use this payment information to process and facilitate the payment of your Subscription Fees so that we may provide you with the service you have requested or to enter into a contract with you to access the Platform.

Where you pay a third party for your Subscription Fees (e.g. the app store) your payment information is directly collected and controlled by that third party. However, we receive invoice receipts from third parties for your purchase and these receipts are stored by us as we have a legitimate business interest to keep them for internal accounting and tax purposes and to comply with our legal obligation as per any applicable laws including any audits, legal proceedings and/or investigations.

Our payment processors have their own privacy policies and practices in place, and we recommend you make yourself aware of these policies and practices before you provide your payment information, and any information shared thereon and your rights in relation to such information will be governed by the relevant payment processor’s privacy policies.

10. Contacting You

We may contact you using the Personal Information you have given us:

  • in relation to the functioning of any service you have signed up for in order to ensure that we can deliver the Services to you;
  • in relation to any transaction entered by you on our Platform to subscribe to Services;
  • where you have opted to receive further correspondence;
  • where you have issued a query or requested information from us;
  • to invite you to participate in surveys, opinion polls, etc., about our Services or otherwise (participation is always voluntary); and
  • to provide you information about our new products and Services.

11. Change of Control

In the event that ownership or control of the Company was to change or the Company engages in a sale of its assets or undertaking, your Personal Information may be transferred to such purchaser, with notice to you. If such a transfer results in a material change in the use of your Personal Information, the Company will provide notice about the choices you have to decline to permit such a transfer.

12. Accuracy

To the extent that you do provide us with Personal Information, we wish to maintain accurate and current Personal Information. Where we collect Personal Information from you in the course of providing Services, should you need to update or correct that Personal Information, please contact us and we will make reasonable efforts to incorporate the changes in your Personal Information that we hold as soon as practicable. We will use our best efforts to send you the information within fourteen (14) days of receipt of your email.

13. Consent; Amendments; Law

By using the Platform and the Services, you consent to the terms of this Policy and to our use and management of Personal Information for the purposes and in the manner herein provided. Should this Policy change, we intend to take every reasonable step to ensure that these changes are brought to your attention by posting all changes prominently on our Platform for a reasonable period of time.

Your visit and any dispute over privacy are subject to this Policy. The said Policy shall be governed by and construed in accordance with the laws of the Republic of India. Further, it is irrevocably and unconditionally agreed that the courts of Bengaluru, India shall have exclusive jurisdiction to entertain any proceedings in relation to any disputes arising out of the same.

In accordance with the Information Technology Act 2000, the name and the details of the Grievance Officer has been published and is available on the Platform here. The Company reserves the right to replace the Grievance Redressal Officer at its discretion through publication of the name and title of such replacement on the Platform, which replacement shall come into effect immediately upon publication.
