Honolulu, H.I. (May 13, 2024) - RAINN, the nation’s largest anti-sexual violence organization released the following statement as Hawaii SB 2439 heads to Governor Josh Green’s desk to be signed into law:
SB 2439 opens up a window for survivors to choose to pursue justice. The bill extends the statute of limitations for two years for civil actions brought by adult survivors of sexual violence. This provides adult survivors of sexual offenses a chance at justice by bringing a claim directly against their perpetrators for the damage those offenders have caused and bringing a claim against legal entities during the 2-year window if there is a finding of gross negligence.
“Opening this 2-year window is integral to the pursuit of justice for survivors in Hawaii,” said Mollie Montague, RAINN director of state legislative affairs. “We’re pleased to see Hawaii take steps forward in supporting survivors. Arbitrary time limits should not prohibit any survivor from the opportunity to seek justice. RAINN thanks Hawaii State Senator Maile Shimabukuro for her sponsorship and stewardship of this critical legislation.”
