So, I was having issues with a site crashing completely when trying to use this script and modernizr together. First of all, is that even needed? I saw someone on Forst saying that modernizr would be enough?

Anyway, I just removed Respond from the site, and now the site loads up fine. Anyone have any ideas on this?

Same problem. The problem isn't modernizr but a background image set to body.
The crash appened on "docElem.removeChild(fakeBody);" row.

Explorer 8 crash if respond.min.js loaded in head with a bacground-image applied to body element.
Resolved loading respond.js in body or removing background-image from body element.
