Commission Directive (EU) 2017/164 of 31 January 2017 establishing a fourth list of indicative occupational exposure limit values pursuant to Council Directive 98/24/EC, and amending Commission Directives 91/322/EEC, 2000/39/EC and 2009/161/EU (Text with EEA relevance)
Scope
A fourth list of Union indicative occupational exposure limit values is hereby established for the chemical agents listed in the Annex (Art. 1).

Regulatory activities
Member States are required to establish national occupational exposure limit values for the chemical agents listed in the Annex of this Directive (EU) 2017/164 taking into account the Union limit values (Art. 2). Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 21 August 2018 at the latest (Art. 7). In underground mining and tunnelling, Member States may benefit from a transitional period ending at the latest on 21 August 2023, as regards the limit values for nitrogen monoxide, nitrogen dioxide and carbon monoxide (Art. 6).

Obligations based on CLP hazard class
On basis of Directive 98/24/EC, classification and labelling provisions under DPD and DSD form the basis for definition of hazardous chemical agents; these have been repealed and replaced by CLP.
