10th anniversary celebration terms and conditions

1. COMPANY ORGANISING THE PROMOTION

The Company Anteco Systems S.L. operating as AnyTech365, hereinafter referred to as “the Company”, with registered office at Ctra Nacional 340 Km 189, Urb. Los Pinos, Local 3, 29604, Marbella, Málaga, Spain and NIF B93311710 organizes for promotional purposes the contest, hereinafter “the Promotion”, of international scope, to be developed through the Internet, exclusively for its users of legal age in accordance with the provisions of the third section, conditions of the promotion and prizes.

The purpose is to allow users to get a free subscription to give to a non-user of the company, by means of a self-recorded video as described below.

2. START DATE AND END DATE

The Promotion will commence on the 22nd of May, 2023 and will end on the 21st of June 2023 at 00:00 hours. The Company reserves the exclusive right to not proceed with the promotion, if by the end of the competition date, there has not been more than 120 participants. Likewise, the Company may extend the end of the competition by 1 month, 1st of July 2023 being the new end date in case the Company foresees that a higher number of participants may be registered. Users will also be informed of the new end date.

3. PARTICIPATION REQUIREMENTS AND MECHANICS OF THE PROMOTION

Participation in the Promotion implies acceptance of the terms and conditions.

The participation requirements are as follows:

  1. Only those persons who are users of our services and of legal age may participate.
  2. Only those who have been previously contacted by the company may participate.
  3. Participants may only register once for the promotion.
  4. The terms and conditions of the Promotion consists of: The Company will send an email to a specific number of users based on their loyalty to the Company. These users will have to send a short video (no longer than 1:30 minutes) by private message to AnyTech365’s Facebook or Instagram accounts telling us of their experience with the Company. In return, all participants will get one-year free PLATINUM service for an unlimited number of home devices to be distributed to three friends or family members (a total of three years).

4. COMPETITION RULES, CONDITIONS AND PRIZES

All participants who submit a short video with appropriate and non-offensive content and which respects the Facebook and Instagram community standards will win the prize. The video can be of any theme, either horizontal or vertical. It must talk about its relationship with AnyTech365, but the content is free: joke, dance, song… The user can choose the content of the video.

The winners will get a prize of a year of PLATINUM service to give to three people (one year for each one). The total value of the prize is 2097€ + VAT.

5. LIMITATIONS

If it becomes evident that any of the participants do not comply with the requirements mentioned in the Rules, or the data provided to participate is not valid, their participation will be considered null and void they will be automatically excluded from the Promotion, losing all rights to the prizes awarded.

The prize may not be accumulated to other offers, nor may it be enjoyed by a current user.

The following persons are not eligible to participate in the Promotion:

  1. Employees of the company or self-employed persons linked to the company.
  2. Natural persons who directly or indirectly participate in the capital of the company.
  3. Any other person who has participated directly or indirectly in the organization of this Competition or who has been directly or indirectly involved in its preparation or development (agency, suppliers, etc.).

The prizes awarded will not be transferable or subject to change, alteration, or compensation at the request of the Participants and cannot be exchanged for any other product or money.

The company reserves the right to make any changes, suspend or extend the competition in the event of just cause and subject to prior legal notice.

The winner will be responsible for any fiscal or tax charges that the acceptance of the prize may entail, as well as any other expenses derived from the promotion that are not expressly assumed by the company in these Legal Bases.

A period of FIFTEEN (15) calendar days is established from the date of the awarding of the prize, to make any justified claim. The company reserves the right to substitute the prize for another of similar characteristics if necessary and if there is just cause.

The winner may not market, sell, offer for sale, auction or in any way use the prize in connection with any other prize draw or promotion.

6. PUBLICATION OF COMMENTS OR OPINIONS

Comments or opinions whose content is considered inappropriate, offensive, abusive, insulting or discriminatory or that could violate the rights of third parties will not be permitted. Nor will comments against any individual that violates their principles of the right to honor, their personal life, family privacy or to their own image, be allowed. We will not be held responsible for any damage caused by comments about third parties made by participants in the competition, or which may offend the sensibilities of other participants.

Any attempt to hinder the smooth running of the Competition, whether by human intervention or by means of an automaton, will result in the immediate disqualification of the entrant and the cancellation of his/her participation.

The participation in this competition, as well as the publication of the comments made by the Participants in the publications may not violate under any circumstances the Instagram Community Rules (https://help.instagram.com/477434105621119/?helpref=hc_fnav). or Instagram’s Terms of Use (https://help.instagram.com/478745558852511). Meta does not sponsor, endorse, or administer this competition in any way, nor is it associated with it. The user dissociates him/herself completely from Meta and is aware that he/she is providing his/her information to the company Anteco Systems S.L. and not to Meta. Participants release said platforms from all liability for any damages that may arise from the same. The information provided will be used to manage the participation of the contestant and to communicate the choice of the winner or alternate, if applicable.

7. DISCLAIMER OF LIABILITY

By way of example, but not limitation, we are not responsible for possible loss, theft, delays or any other circumstance attributable to third parties that may affect the development of the competition, nor are we responsible for the use made by the participant with respect to the prize obtained from this Promotion, and do not assume any responsibility for any damage or harm of any kind that may be suffered by the Participants, winner or third parties.

We do not assume responsibility in cases of force majeure or unforeseeable circumstances that could prevent the contest from taking place or the total or partial enjoyment of the prize. If the contest cannot be carried out, either due to fraud detected in the contest, technical errors, or any other reason that is not under the control of the company and that affects the normal development of the contest, we reserve the right to cancel, modify, or suspend the contest.

8. PROTECTION OF PERSONAL DATA

Anteco Systems SL takes the protection of your privacy and personal data very seriously.

In accordance with the provisions of the EC, Article 18.4, the regulatory development of this right through Organic Law 15/1999, in the applicable regulations on data protection, and also in Regulation (EU) 2016/679 of the European Parliament and of the Council, 27th of April 2016, on the protection of individuals with regard to the processing of personal data and the free movement of such data, each Participant, by accepting these Legal Terms and Conditions, consents to the personal data provided for the participation in this competition being included in a file owned by Anteco Systems SL to process the participation in the competition and to communicate the prize in the event that he/she is the Winner.

Your social media username will be used for the following purposes: publication on social networks and video editing with parts or all of the videos, with the rights to the resulting product and the videos themselves being fully reserved by Anteco Systems SL.

Participants guarantee that the personal data provided, are truthful and are responsible for informing Anteco Systems SL of any changes to them.

The company reserves the right to exclude from this Promotion any participant who provides false data. It is recommended to take the utmost care in terms of Data Protection using security tools, and the company cannot be held responsible for illicit thefts, modifications or loss of data.

Participants are entitled to:

  1. access their personal data.
  2. request the rectification of inaccurate data or, where appropriate, request their elimination.
  3. request the restriction of the processing of your data.
  4. object to the processing of your data

Without prejudice to any other administrative or judicial remedy, the Participant shall have the right to lodge a complaint with a Supervisory Authority, in particular in the Member State in which he/she has his/her habitual residence, place of work or place of the alleged infringement, in case he/she considers that the processing of his/her personal data is not lawful, as well as in the event that the exercise of his/her rights are not satisfied.

The Control Authority to which the complaint has been submitted shall inform the complainant about the follow-up and the outcome of the complaint.

9. CHANGES

We reserve the right to modify or extend these Promotional Terms and Conditions, to the extent that it does not prejudice or undermine the rights of the participants in the Promotion. The mere fact of participating in the draw implies that the Participant fully accepts the conditions of these Terms and Conditions. Likewise, participation in a prize draw of this nature implies acceptance of the rules of the Instagram/Facebook social network through which it is carried out.

10. APPLICABLE LAW AND JURISDICTION

These terms and conditions shall be governed in accordance with Spanish law.

The Courts and Tribunals of Marbella, Málaga will be competent to resolve any claim or dispute that may arise in relation to the validity, interpretation or fulfilment of these terms and conditions.
